Do you know when and how a will is made effective?
A will is made effective when the person who has made the will dies. The will is then admitted to probate.
A will can be changed any time whilst the person is alive and is not able to be submitted to probate until the person has passed.
When a will is offered for probate, it is admitted to probate by a court with probate jurisdiction. This involves a hearing where evidence is presented on the validity of the will, the family of the person who wrote the will, the death and other matters. If the necessary proof is presented the will be made effective.
