To avoid the Court making decisions on your behalf, it is beneficial to create a Lasting Power of Attorney because it allows you to decide in advance:

(a) The decisions you want to be made on your behalf if you lose the capacity to make them yourself;
(b) The people you want to make these decisions; and
(c) How you want the people to make these decisions
