If your loved one has not left specific instructions regarding the scattering of their ashes, you may be wondering whether there are any restrictions regarding the scattering of their ashes in Essex.

Religious guidance

If your loved one was religious, this may give you some guidelines as to how to scatter their ashes. If you wish to scatter ashes within a cemetery, burial ground, or memorial garden you will simply need to contact the owner of the ground for permission. However, some religions are stricter on the scattering of ashes. For example, if your loved one was of Hindu faith then strictly speaking their ashes would be required to be scattered into the Ganges river. However, there are several alternative river sites that have now been designated for Hindu ash scattering in the UK. Alternatively, if your loved one was Catholic, then their ashes would be required to be buried rather than scattered. It is always advisable to contact a representative of your loved one’s faith to discuss any particular requirements should you be unsure of the appropriate procedures.

If your loved one had no particular religious beliefs then you will need to consider the legal restrictions regarding scattering ashes in the UK before deciding upon a suitable location.

Private land

You are able to scatter ashes on your own land, but you must receive express permission from the landowner before scattering ashes on privately owned land.

Common land

Land such as a village green is accessed without restriction to the public. However, it is legally owned by someone and therefore you would need to seek permission from the appropriate landowner before scattering ashes on common land.

Scattering ashes across the water

The Environmental Agency offers guidelines to assist you to scatter your loved one’s ashes over the water whilst ensuring that no harm is done to the surrounding natural environment. You can request further information from your local Environmental Agency office.
